In a February warning letter addressed to the company, the Food and Drug Administration said an Iowa outbreak occurred in November and December, sickening 22 people. It said Iowa health officials traced the infections to 15 Jimmy John's restaurants that served clover sprouts, but it did not provide the specific locations. On Wednesday, the U.S. Centers for Disease Control Prevention reported that Jimmy John's clover sprouts were linked to another outbreak in January and February that included three cases in Iowa. The CDC warned that individuals who ate clover sprouts from the sandwich chain before Monday may develop the E. coli infection. James North, CEO of Jimmy John's, said in a Wednesday statement that the chain's more than 2,800 locations had permanently stopped serving clover sprouts as of Monday. "Sprouts present particular challenges, given our unwavering commitment to world-class food safety standards," North said in the statement. "Therefore, we made the decision to permanently remove sprouts from all restaurants and acted swiftly to do so." The sprouts linked to the late 2019 Iowa outbreak came from Sprouts Unlimited Inc., a grower in the Cedar Rapids suburb of Marion that also received an FDA warning letter. State officials did not respond to a question about whether further action involving the company was planned.The company also did not respond to a request for comment. In the warning letter, the FDA said it had inspected the Sprouts Unlimited facility and found serious sanitation and other problems. It said it had determined "that your clover sprouts bear or contain an added poisonous or deleterious substance which may render them injurious to health." The letter gave both Jimmy John's and Sprouts Unlimited 15 days to respond with details about how they would address the problems. The letter addressed to Jimmy John's also referenced outbreaks in Illinois, Minnesota and Wisconsin in 2018; in California, Idaho, Michigan, Montana, Utah and Washington in 2014; in Colorado in 2013; and in 11 states in 2012, all of which it said had been linked to sprouts, or in one case, cucumbers. The letter accuses Jimmy John's of engaging in a pattern of receiving and selling “adulterated fresh produce, specifically clover sprouts and cucumbers.” It says Jimmy John's told the FDA after the 2012 outbreak that it would use only sprouts from producers that complied with FDA regulations, but that inspections since then have shown the restaurants are using "multiple other sources of sprouts." "Jimmy John’s has not demonstrated implementation of long-term sustainable corrections to its supply chain to assure the safety of ingredients used in its products," Frank Yiannas, FDA deputy commissioner for food policy and response, said in a statement. “Americans expect the foods they consume to be safe. We will hold companies accountable when they do not take adequate measures to ensure the safety of the foods they provide.”
